Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mclenhub website, applications, learning products, courses, Career Paths, Career Accelerator Program, checkout services, mentorship services, physical training services, and related services (collectively, the "Services") operated by Mclenhub ("Mclenhub", "we", "us", or "our").

By accessing or using the Services, creating an account, submitting an application, enrolling in a course or program, or completing a purchase, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Services.

Where applicable, additional terms may apply to specific courses, programs, promotions, or services. If additional terms conflict with these Terms, the specific additional terms will apply to the extent of the conflict.

You must be at least 16 years old, or the age of majority applicable to you if higher, to use the Services independently.

If you are under the age of majority applicable to you, you may only use the Services with the involvement and consent of a parent or legal guardian where required by applicable law.

If you use the Services on behalf of an organization, you represent and warrant that you have authority to accept these Terms on that organization's behalf.

You are responsible for maintaining the confidentiality and security of your account credentials and for activities conducted through your account.

You must provide accurate and current information when creating an account or applying for a program.

You must notify Mclenhub promptly at hello@mclenhub.com if you suspect unauthorized access to your account.

Course enrollments, Career Path selections, and Career Accelerator applications are personal to the enrolled student unless Mclenhub expressly agrees otherwise in writing.

You may not sell, transfer, sublicense, share, or commercially exploit paid access without Mclenhub's prior written consent.

Mclenhub may require reasonable verification of identity or enrollment information where necessary to protect the Services or prevent fraud or unauthorized access.

The Services and their contents—including software, source code, user interfaces, page layouts, branding, logos, the "Learn. Build. Launch." tagline, curriculum structure, Career Path structure, Career Accelerator materials, marketing materials, videos, images, written content, pricing presentation, and other materials—are owned by Mclenhub or its licensors and are protected by applicable intellectual-property laws.

Except for the limited rights expressly granted under these Terms, no ownership rights are transferred to you.

Mclenhub grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal learning and other authorized purposes.

Unless expressly permitted by Mclenhub in writing, you must not:

• copy, reproduce, distribute, mirror, scrape, crawl, or bulk-download the Services or their content;
• reverse engineer, decompile, disassemble, or attempt to extract source code or underlying logic;
• recreate, clone, or substantially reproduce Mclenhub's website, product flows, curriculum structure, learning experience, or branding;
• remove copyright, trademark, or proprietary notices;
• use Mclenhub trademarks, logos, trade dress, or confusingly similar names without authorization;
• frame, embed, redistribute, sublicense, or resell Mclenhub content;
• share paid course materials or account credentials with unauthorized persons;
• use automated tools, bots, scripts, or headless browsers to access the Services without authorization; or
• use Mclenhub's content to create or operate a competing educational service where such use infringes Mclenhub's intellectual-property rights.

Unauthorized use may result in suspension or termination of access and Mclenhub may pursue remedies available under applicable law.

You retain ownership of content you submit to Mclenhub, including resumes, portfolio links, project code, assignments, messages, and other materials you provide ("Your Content").

You grant Mclenhub a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display Your Content only as reasonably necessary to provide, administer, secure, and improve the Services and your participation in Mclenhub programs.

Mclenhub will not publicly showcase your personal information, portfolio, success story, testimonial, project, photograph, or other identifying content for marketing purposes without your appropriate consent.

You represent that Your Content does not infringe another person's intellectual-property, privacy, or other legal rights and does not violate applicable law.

Prices may be displayed in Nigerian Naira (NGN) or United States Dollars (USD), depending on the payment option selected.

NGN and USD prices may be independently configured and do not necessarily represent live currency conversions.

Applicable taxes, fees, physical-training surcharges, or other charges will be disclosed at checkout or before payment where applicable.

Payments may be processed by third-party payment providers, including Paystack, Stripe, or other payment processors made available by Mclenhub.

Payment-card information is processed by the applicable payment provider and is not intentionally stored on Mclenhub's servers.

By completing a purchase, you authorize the applicable payment provider to process the payment for the amount displayed at checkout.

All purchases are subject to the Mclenhub Refund and Cancellation Policy, which forms part of these Terms.

Mclenhub provides educational and career-development services, including courses, Career Paths, mentorship, practical projects, career guidance, physical training, and the Career Accelerator Program.

Mclenhub's Services are intended to develop knowledge, practical skills, portfolio materials, career readiness, and related capabilities.

Mclenhub does not guarantee employment, a particular salary, number of interviews, freelance income, business revenue, promotion, admission, investment return, or any other specific financial or professional outcome, unless expressly provided in a separate written agreement signed by an authorized representative of Mclenhub.

Career guidance, portfolio reviews, CV/resume guidance, interview preparation, and mentorship are advisory and educational services and do not constitute a promise of employment.

Any salary figures, career outcomes, testimonials, success stories, or examples displayed by Mclenhub are illustrative and should not be interpreted as guarantees of future results.

Physical training, customized learning paths, corporate training, and other services requiring individual arrangements may be subject to administrative review and a separate quotation.

A quotation does not constitute a confirmed enrollment until Mclenhub confirms the booking and, where applicable, payment has been received.

Custom Career Paths or combinations of courses may require a manual quotation where no standard package applies.

You agree to:

• provide accurate information;
• participate honestly in courses and assessments;
• complete your own assignments and projects unless collaboration is expressly permitted;
• respect tutors, mentors, staff, and other learners;
• maintain the confidentiality of your account;
• comply with applicable laws;
• protect your own passwords and credentials; and
• maintain appropriate backups of important personal files and project materials.

You are responsible for your own learning progress and for decisions you make based on educational or career guidance provided through the Services.

You must not use the Services to:

• violate any applicable law or third-party rights;
• harass, threaten, abuse, or discriminate against tutors, mentors, staff, or learners;
• share account credentials or paid course materials without authorization;
• bypass or attempt to bypass paywalls, pricing, access controls, or security measures;
• introduce malware, malicious code, or other harmful material;
• interfere with or disrupt the Services;
• impersonate another person;
• misrepresent your identity, qualifications, experience, or credentials;
• fraudulently obtain access to courses or programs;
• scrape or systematically extract Mclenhub content without authorization; or
• use the Services to facilitate unlawful activity.

Mclenhub may suspend or terminate accounts involved in prohibited conduct, subject to applicable law.

If you believe material available through the Services infringes your copyright, contact hello@mclenhub.com with sufficient information for us to investigate the complaint, including:

1. identification of the copyrighted work;
2. identification and location of the allegedly infringing material;
3. your contact information;
4. a good-faith statement explaining the alleged infringement; and
5. confirmation that the information provided is accurate and that you are authorized to act for the rights holder where applicable.

Mclenhub may remove or restrict access to material where appropriate and may take action against repeat infringers.

The Services are provided on an "as available" basis.

Mclenhub will make reasonable efforts to provide accurate, useful, and reliable educational and career-development services. However, Mclenhub does not guarantee that the Services will always be uninterrupted, error-free, completely secure, or available at all times.

Educational materials may become outdated as programming languages, frameworks, technologies, industry practices, and employment requirements change.

Nothing in these Terms excludes or limits any consumer right, statutory protection, warranty, or liability that cannot lawfully be excluded or limited under applicable Nigerian law.

To the maximum extent permitted by applicable Nigerian law, Mclenhub will not be liable for indirect, incidental, special, or consequential loss arising from your use of the Services.

This may include, where legally permissible:

• loss of anticipated profits;
• loss of business opportunities;
• loss of anticipated income;
• loss of employment opportunities;
• loss of goodwill;
• loss of reputation;
• loss of anticipated savings; or
• other consequential financial losses.

Mclenhub is not responsible for outcomes that depend substantially on circumstances outside its reasonable control, including employer decisions, job-market conditions, economic conditions, third-party service failures, internet connectivity, or a student's individual effort or decisions.

Liability Cap

Subject to any liability that cannot legally be excluded or limited under Nigerian law, Mclenhub's aggregate liability arising directly from a particular Service shall not exceed the total amount actually paid by the affected customer to Mclenhub for that Service during the twelve (12) months immediately preceding the event giving rise to the claim.

Where no payment was made for the relevant Service, any applicable liability limitation will be determined subject to applicable law.

Mandatory Legal Rights

Nothing in these Terms is intended to:

• exclude liability for fraud or fraudulent misrepresentation;
• unlawfully exclude liability for negligence;
• remove mandatory consumer rights;
• exclude rights or remedies that cannot legally be excluded;
• exclude obligations imposed by applicable Nigerian data-protection legislation; or
• otherwise restrict any liability that applicable law prohibits Mclenhub from restricting.

If applicable law prohibits the exclusion or limitation of a particular liability, that liability will remain unaffected by this section.

Mclenhub may use third-party providers for payment processing, hosting, communication, authentication, video delivery, analytics, software tools, and other services.

Your use of third-party services may be subject to the applicable third party's own terms and policies.

Mclenhub is not responsible for independent third-party services outside Mclenhub's reasonable control, except where Mclenhub is legally responsible for the relevant matter.

Mclenhub may collect and process personal information in connection with your use of the Services.

Our collection, use, storage, and processing of personal data is governed by our Privacy Policy and applicable Nigerian data-protection law.

By using the Services, you acknowledge that your personal information may be processed as described in the Privacy Policy.

Mclenhub may suspend or terminate your access to the Services where reasonably necessary due to:

• violation of these Terms;
• fraudulent or unlawful activity;
• unauthorized sharing or distribution of paid content;
• conduct that materially harms Mclenhub, its staff, tutors, mentors, or other users; or
• circumstances requiring suspension to protect the security or integrity of the Services.

Where appropriate and legally required, Mclenhub will provide notice and an opportunity to remedy the relevant violation.

You may stop using the Services at any time.

Termination does not affect rights or obligations that by their nature should survive termination, including provisions concerning intellectual property, payment obligations, disclaimers, limitations of liability, dispute resolution, and other applicable provisions.

These Terms are governed by the laws of the Federal Republic of Nigeria.

Mclenhub and its customers will endeavour to resolve disputes through good-faith communication before commencing formal proceedings.

Nothing in this section prevents a consumer from exercising any mandatory right or remedy available under applicable Nigerian consumer-protection law.

Where a dispute cannot be resolved informally, it may be submitted to a court or other dispute-resolution forum having lawful jurisdiction over the matter.

Mclenhub may update these Terms from time to time.

The updated version will be published on the Mclenhub website with a revised effective date.

Where required by applicable law, Mclenhub will provide reasonable notice of material changes.

Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.

If it cannot be made enforceable, the provision will be severed without affecting the validity of the remaining provisions.

These Terms, together with the applicable Refund and Cancellation Policy, Privacy Policy, and any additional terms expressly incorporated into them, constitute the agreement between you and Mclenhub concerning your use of the Services.

They supersede previous agreements or understandings concerning the same subject matter, except where a separate written agreement expressly states otherwise.
